Billing Terms

These Billing Terms are incorporated into the AtClosing's Terms of Service (/terms-and-conditions) and govern all payments and referral-related transactions made in connection with AtClosing’s Pay-at-Closing program (the “Program”). In the event of any conflict between these Billing Terms and the Terms of Service, these Billing Terms shall control.

1. Enrollment Fee. To activate your participation in the Program, you agree to pay a one-time Enrollment Fee. This Enrollment Fee is used to verify your account, set up your campaign, and secure your exclusive territory or ZIP codes. The Enrollment Fee is non-refundable but will be fully credited toward your first referral payment due at closing. No ongoing monthly subscription or ad budget is charged under this Program.
2. Referral Payments at Closing. When a transaction generated through AtClosing’s leads results in a successful closing, you authorize AtClosing to collect the agreed-upon referral fee (“Referral Payment”) at that time. The Referral Payment amount is defined in your Referral Agreement or campaign offer and is calculated based on the gross commission earned by you or your brokerage at closing. Your Enrollment Fee credit will automatically apply toward your first Referral Payment balance.
3. Payment Method. All payments must be made using a valid credit or debit card issued by American Express, MasterCard, Discover, or Visa (“Payment Method”). You are responsible for keeping your Payment Method details current at all times. By submitting your Payment Method, you certify that you are an authorized user of that card and authorize AtClosing to charge it for any fees due under these terms.
4. Billing Authorization. You authorize AtClosing to automatically charge your Payment Method for:
- (a) The one-time Enrollment Fee at the time of registration.
- (b) Any Referral Payments due upon closing of a transaction that originated through AtClosing leads.
Charges may be processed directly or via an authorized third-party payment processor. You agree to promptly notify AtClosing of any billing disputes or errors.
5. Refunds and Credits. The Enrollment Fee is strictly non-refundable but will be applied as a credit toward your first Referral Payment at closing. If you do not close a transaction through the Program, no refund or credit will be issued. Referral Payments already processed are final and non-refundable, except where required by law or at AtClosing’s sole discretion.
6. Closing Verification. You agree to provide verification of any closings that result from leads received through AtClosing, including closing statements, transaction dates, and gross commission information. Failure to disclose a closing or to remit Referral Payments in good faith may result in suspension or permanent removal from the Program and collection actions.
7. Late or Failed Payments. If a Referral Payment fails or is disputed after closing, AtClosing may assess a $50 processing fee for each failed transaction and may suspend or terminate your account. You are responsible for all costs of recovery, including reasonable collection fees and attorney’s fees.
8. Billing Disputes. To dispute a charge, you must contactAtClosing in writing at support@AtClosing.com within 30 days of the charge. You agree not to initiate a chargeback with your bank or credit card provider during this 30-day period, allowing AtClosing time to resolve the dispute. Accounts involved in chargebacks will be immediately suspended pending resolution.
9. Termination. You may cancel your participation in the Program at any time by contacting AtClosing Support. However, the Enrollment Fee remains non-refundable, and any Referral Payments owed for closed transactions remain due in full.
10. Modifications. AtClosing reserves the right to modify these Billing Terms at any time. Updated versions will be posted at this page, and continued participation in the Program after such changes constitutes acceptance of the updated terms.
